Grainwork Terms of Service

These Terms of Service ("Terms") are a contract between you and Grainwork ("we," "us," "our"). They govern your use of the Grainwork mobile app and related services (together, the "Service"). By using the Service, you agree to these Terms. If you don't agree, please don't use the Service.

1. Who can use Grainwork

You must be at least 18 years old and able to enter into a contract to use the Service. Grainwork is built for the United States — its pricing, labor-rate data, and ZIP-code inputs are U.S.-specific, and it is offered through the U.S. app stores.

2. What Grainwork is — and what it isn't

Grainwork generates automated repair cost estimates from videos or photos of home damage, and can review a contractor's written quote to help you judge whether it looks fair.

Estimates and quote reviews are automated, approximate, and provided for informational purposes only. They are not professional advice, not a home inspection, not an appraisal, and not a guarantee of what a repair will actually cost. Real-world costs vary with conditions that can't be seen on a video, local market rates, materials, and the contractor you choose. A quote review is an independent, informational opinion — not a recommendation to accept or reject a quote, and not a recommendation to hire or avoid any contractor.

We are not a contractor, home inspector, or appraiser. We do not perform repairs, and we do not endorse, refer, or sell leads to contractors. You are solely responsible for any decisions you make based on the Service, and for getting professional advice before acting on anything significant.

You can use Grainwork without an account, or sign in with Apple or Google. You can delete your account and its associated data at any time in the app under Settings, as described in our Privacy Policy. We may suspend or terminate access that violates these Terms or that we reasonably believe is harmful to the Service or others.

5. Purchases, credits, and refunds

Some features (such as quote reviews) are paid. Purchases are made through the Apple App Store or Google Play, and billing, taxes, and refunds are handled by those stores under their own terms — not by us. Credits are a limited license to use a paid feature; they are non-transferable, have no cash value, and are non-refundable except where required by law or store policy. We may change features, credits, or prices over time.

6. Your content and the license you give us

You keep ownership of the videos, photos, audio, and quote details you upload ("Your Content"). You grant us a worldwide, royalty-free license to host, process, and analyze Your Content to provide the Service, and to retain and use it in de-identified form to calibrate and improve the Service, as described in our Privacy Policy. You represent that you have the right to upload Your Content and that it doesn't infringe anyone's rights or break any law.

7. Acceptable use

Don't use the Service to break the law or harm others. Don't reverse engineer, scrape, overload, probe, or interfere with the Service or its security, and don't try to access it in ways we haven't authorized. Don't upload content you don't have the rights to.

8. Our intellectual property

We own the Service, including the app, software, and Grainwork brand (everything other than Your Content). We grant you a limited, revocable, non-exclusive, non-transferable license to use the app for your own personal, non-commercial use. No other rights are granted.

9. Third-party services and the app stores

The Service relies on third-party providers (such as Google Cloud) that operate under their own terms. These Terms are between you and Grainwork, not Apple or Google. The app stores are not responsible for the Service and have no obligation to provide support or maintenance for it. To the extent you downloaded the app from the Apple App Store, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm you are not located in a country subject to a U.S. embargo and are not on a U.S. prohibited-parties list, and you'll comply with the applicable app store's terms.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY LAW. We do not warrant that the Service will be accurate, reliable, uninterrupted, or error-free, or that any estimate or quote review will match actual repair costs or outcomes.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, Grainwork will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits or data, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) US $100. Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.

12. Indemnification

You agree to indemnify and hold Grainwork harmless from claims, losses, and expenses arising out of your misuse of the Service, Your Content, or your violation of these Terms or any law.

13. Changes

We may update the Service or these Terms from time to time. If we make material changes to these Terms, we'll update the "Last updated" date above and notify you through the app or by email. Continuing to use the Service after a change means you accept the updated Terms.

14. Termination

You can stop using the Service at any time and delete your account in the app. We may suspend or end your access if you violate these Terms or to protect the Service or its users. Provisions that by their nature should survive — including the content license for de-identified data, disclaimers, limitation of liability, and indemnification — survive termination.

15. Governing law and disputes

These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-law rules. If you have a problem, email us first at [email protected] and we'll try to resolve it informally. Any dispute we can't resolve that way will be handled exclusively by the state or federal courts located in Illinois, and you consent to their jurisdiction.
